Booking and Refund Policy

1. Acceptance of Terms

By proceeding with the booking and submitting payment for any session, block, course, or service offered by Gwdihŵ Baby Group (hereinafter referred to as "Gwdihŵ"), the purchaser (hereinafter referred to as the "Client") acknowledges that they have read, understood, and agreed to be legally bound by all terms and conditions outlined in this Refund Policy. This policy forms an integral part of the service agreement between Gwdihŵ and the Client.

2. General Principle of Non-Refundability

2.1. Non-Refundable Nature: All fees paid to Gwdihŵ for bookings are strictly non-refundable. This policy is in place due to the fixed operational costs, limited capacity, and the necessity of securing instructor and venue resources based on confirmed enrollment numbers.

2.2. Enrollment Confirmation: Once payment is processed, the enrollment slot is secured, and Gwdihŵ commits resource allocation based on this confirmation. No monetary refunds shall be issued subsequent to this point, irrespective of the Client's ability to attend.

3. Client-Initiated Cancellations and Absences

No compensation, monetary refund, credit, or transfer will be provided in the event of cancellation or non-attendance initiated by the Client. This includes, but is not limited to, circumstances arising from:

3.1. Illness or Injury: Non-attendance due to illness (of the child, parent, or accompanying adult), injury, or medical appointments.

3.2. Personal Commitments: Conflicts with travel, holiday plans, work schedules, or other unforeseen personal circumstances.

3.3. Voluntary Withdrawal: The Client deciding to withdraw from the block or course prior to or during its commencement.

3.4. Transportation Issues: Inability to attend due to issues related to transport or parking.

3.5. Late Arrival/Early Departure: No pro-rata refund or credit will be offered for partial attendance of a session.

4. Cancellation or Interruption by Gwdihŵ

Should Gwdihŵ be compelled to cancel an individual session or an entire block/course, the following compensation provisions shall apply:

4.1. Option for Rescheduling (Primary Remedy): Gwdihŵ shall first seek to offer a suitable alternative date and time for the cancelled session(s). The rescheduled session(s) shall be deemed full compensation for the cancellation.

4.2. Issuance of Credit (Secondary Remedy): If a suitable alternative date cannot be offered by Gwdihŵ, or if the offered date is demonstrably and unreasonably inconvenient to the Client, Gwdihŵ will issue a session credit equivalent to the pro-rata value of the cancelled session(s).

Note: This credit can be applied towards any future booking with Gwdihŵ within a period of twelve (12) calendar months from the date of the original cancellation. The credit holds no cash value and cannot be redeemed for a monetary refund.

4.3. Force Majeure: In the event of session interruption or cancellation due to Force Majeure (e.g., acts of God, governmental decree, pandemic lockdowns, natural disasters, severe weather events impacting public safety, or venue structural failure), Gwdihŵ will apply the provisions of Section 4.1 and 4.2. Gwdihŵ shall not be held liable for any indirect or consequential losses resulting from a Force Majeure cancellation.

5. Transfer of Bookings

Bookings are strictly non-transferable. A confirmed booking cannot be:

  • Transferred to an alternate course or block of sessions once the original one has commenced.

  • "Held over" or deferred to a later term due to non-attendance.

 
6. Statutory Rights

This Refund Policy does not affect the Client's statutory rights under applicable consumer protection legislation.

 
7. Governing Law and Jurisdiction

This Refund Policy and any disputes or claims arising out of or in connection with it shall be governed by and construed in accordance with the laws of England and Wales, and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
